Purchase Terms and Conditions
Present Purchase Terms and Conditions include the contract terms pertaining to the orders made in our web shop (referred to as web shop in the following) operated under the domain titatuta.com. By purchasing in the web shop you acknowledge that you have met and accepted the regulations of the present terms and conditions. If you do not accept this, please abort the purchasing process!

Information on the terms of contracting
Titatuta.com serves solely adult persons capable of acting. By accepting the present conditions the customer declares that he/she is counts as adult. The language of contracting is English, the contract qualifies as written contract, since the parties agree that the communication between Titatuta.com and the customer (referred to as customer in the following), taking place via the email address present in the customer’s registration data or order data, specifies as written communication. The contract is not filed.
On the part of Titatuta.com, the operator of the web shop, the CreArt MD Ltd. (Gorkij str. 22., Miskolc H-3533, Hungary) is authorized to enter into contracts and invoices.
Choosing products
The customer can choose and order items from the products of the web shop. The customer can view a detailed product description by clicking on the chosen item. In case of purchasing intention you can put the chosen item into a virtual basket by clicking on the [Order] button. By clicking on the [View Basket] button you can find the products you put into the basket during shopping, and see the total price of your order and the cost of delivery. You may check the exactness of your purchase here, with special attention to prices and quantities, which details you can modify and correct as well. The basket will calculate the total price of your order automatically.
Sending you order
If you found the quantity of items in the basket correct, checked the total price, and decided to complete your order then you simply click on the [Checkout] button. After this you can decide whether you want to log in as a registered user or you wish to register as new customer, or perhaps you want to shop as an unregistered user. If you have purchased earlier in our web shop you should give the email address and password provided at the time of the registration. If you want to sign up as a new customer you must give your data necessary for shopping, the system will store these data, and next time you will only have to log in. In case you would like to shop without registration, you must give your billing address and delivery address only. In the next step you can choose the method of delivery and method of payment. If you agree with the content of your order, to send your order you should click on the [Order] button.
The process, modification, and cancellation of orders
After completing the order, Titatuta.com will send a message to the customer about the purchase, on the basis of which a transport (sales) contract comes into being between Titatuta.com and the customer. The order completed by the customer, the confirmation of the order and the present Terms and Conditions prevail to this contract. The customer accepts the conditions of this sales contract by completing his/her order.
In case if this confirmation does not arrive to the customer within 48 hours, the bidding obligations of the customer cease to exist. The customer will receive a message about the expected new date of delivery.
Titatuta.com ensures a chance to withdraw his/her order via email until the time the web shop starts completing the order. At the time of the beginning of the fulfilment of the order, the customer will receive a notification via email and/or on phone about the possible date of delivery, and about the fact that the web shop started fulfilling their order, after this, he/she has chance to withdraw his/her order either personally, or through one of the contacts listed under [Customer Service] or [Contact] menus.
The post-factum modification of the order can happen only via email, which counts as written notice.
Prices
Our prices are valid list prices at the time of the purchase, you can find these near the items on Titatuta.com. These prices are gross cost, they include sales tax, but these prices does not contain the cost of delivery, and additional taxes or customs in effect in the destination country. One can find the price of delivery in the product description (informatively), and in the checkout process before finalizing your order.
We cannot serve with further information concerning possible customs and taxes of the destination country, the customer is charged by the payment and return of these.
The prices are indicative. In case an error or deficiency occur pertaining to items or costs in the web shop we maintain the right for correction. In such cases, after recognizing and correcting the error we inform the customer immediately about the new data. The customer can confirm his/her order once more, or we offer a possibility for either party to withdraw from the contract.
The web shop maintains the right to modify the cost of items. Possible changes in prices does not affect the cost of products ordered before the modification.
Payment conditions
In the web shop you can pay with money transfer in advance and by credit card online. The completion of credit card payment is performed by our contractual partner. The payment of the product’s price and the cost of delivery happens before transport in all cases. It is a criterion of the transport to pay for the total purchase price and the cost of delivery in advance. The sequence of starting deliveries depends on the succession of the arrival of payments for orders.
Delivery
The transportation of purchased items can happen by mail or courier service. The web shop informs the customer about the time of delivery during the checkout process, and it is also included on the confirmation email.
The time of delivery: the time of delivery sent in the confirmation notice depends on the geographical location of the destination address, and the chosen transportation method, which we have no control of. Titatuta.com undertakes that we start delivering the items in stock within 1, but maximum 3 workdays. In case of products not in stock this time is minimum 14 workdays, but dependent on some products and the busyness of the manufacturing process this time may vary.
We inform the customer about the prices of transport during the process of ordering.
The cancellation of delivery
Titatuta.com reserves the right to cancel the delivery, if the web shop cannot fulfil the responsibility undertook in the contract because item defined in the contract does not available anymore, and if it cannot provide the ordered service. In such cases we inform the customer, and pay back the price of the purchased item in every case, or – according to the declaration of the customer – counts it into the price of another order.
We send the invoice belonging to the purchase in printed form together with other documents related to transport (delivery note, customs form) on the outer surface of the package.
Return guarantee
In case if it comes to light after opening the package in the presence of the delivery person (courier) that the product is demonstrably damaged, and that the damage happened before the takeover, we immediately grant the cancellation of the sale and the return of the product. All kinds of damage or lack of content that is revealed at the time of delivery must be included on the deliverer-recipient factsheet! We do not take responsibility for possible post factum damages and content shortage!
Warranty
In case of warranty, according to the conditions included on the Warranty Booklet or defined by the law, Titatuta.com is obliged to do well for the faulty fulfilment of an order for the time of the warranty. Warranty does not affect the customer’s rights originating from legislation (thus, for example the right pertaining to the warranty for latent defects). Titatuta.com exempt from this warranty obligation, if it can prove that the damage happened after the takeover of the package.
Within the framework of a contract signed with a customer who counts as a consumer there is a warranty obligation for the sold durable consumer products, which time duration is 365 days. The warranty claim can be validated only during the warranty period, the failure to meet this deadline results in the loss of the right for warranty.
The customer can indicate his/her claim for warranty by presenting the warranty card attached to the product, or in case of lack of such document, by presenting the invoice.
Warranty for latent defects
The fulfilment of order by Titatuta.com is faulty if at the time of the fulfilment the item purchased by the customer does not meet the quality requirements defined in the contract or by the law.
The fulfilment of the order does not qualify faulty, if the customer knew, or should have known about the damage at the time of signing the contract. Titatuta.com owes warranty for latent defects of the product. The customer’s warranty for latent defects in the product expires in 2 years counted form the time of the fulfilment of the order, in case of other users – who does not count as consumer – the warranty for latent defects in the product lasts for 1 year counted from the fulfilment of the order.
If the purchased item is a used product, the limitation date of the warranty is 1 year. The customer is bound to indicate the defective product immediately after recognizing it without delay. In case of consumers, the error reported within 2 months after recognition must be handled as reported without hesitation. The customer is responsible for any damage originating from the delay of reporting an error.
In case of warranty for latent defects the customer can choose:
- primarily between repair or change;
- secondarily a commensurate reduction of the price (discount) in the consideration;
- or to withdraw – except for insignificant errors – from the contract.
The customer can change from a chosen form of consideration to another one. He/she must pay for the expenses resulting from the change, except for if Titatuta.com gave a reason for the change, or the alteration of the demand was justifiable.
Product warranty
These terms are applicable only in case of consumer contract!
A product is faulty – and falls under the conditions of product warranty – in case if it does not meet the quality requirements that were in effect at the time when the manufacturer put the product on the market, or if it does not possess the features that the manufacturer included in the product description.
In case of a faulty product sold to a customer by Titatuta.com, the customer can demand from the manufacturer (the product’s creator and distributor specify as manufacturer) to repair, or – if the repair cannot happen within a proper time, or not possible without causing grievance to the customer’s interest – exchange the product.
Product warranty covers the manufacturer for one year counted from the coming out with the product on the market. The passing of this time results in the loss of the right for product warranty.
The manufacturer exempt from the obligation for product warranty if they prove:
- that they manufactured or distributed the product not under business activity or self-employed business;
- at the time of the coming out of the product on the market, the fault of the product was not be recognizable according to the state of science and technology;
- or the fault of the product was caused by the application of laws, or obligatory magisterial regulations.
After recognizing the fault, the customer is obliged to report the error without delay. An error reported within 2 months after recognition must be handled as reported without hesitation. The customer is responsible for any damage originating from the delay of reporting an error.
The right to withdraw from the purchase
If the customer counts as consumer he/she has the right to withdraw from the purchase.
The consumer can withdraw from the purchase by making the statement including his/her clear withdrawal intention by post or on the online interface ensured by Titatuta.com.
The customer must make the statement of withdrawal within 14 days counting from the time he/she received the product, without giving a reason for it.
To enforce your right for withdrawal it is not compulsory (optional), but we kindly ask you to provide you bank account number, and if it is possible, the order number of the product, and a brief description of the error you discovered in it!
If the consumer withdraws from the contract, he/she bears the expenses of returning the product because of practising his/her right for withdrawal!
We take back products only in their original state, and possibly in their own package, in complete quantitative and qualitative stance.
The paying back of the sales price happens via bank money transfer, for which Titatuta.com asks the consumer to give his/her bank account number, considering that bank money transfer is cheaper and faster for the consumer, than other payments methods which were available at the time of the purchase. Refund can happen only after we received back the product affected by withdrawal. You must send the product back to the postal address of Titatuta.com, within 30 days counted form the notification of withdrawal intention. We consider your notification met the deadline if the product arrives back to us in 30 days. The products can be sent back to us either by post or by courier, there is no possibility to return a product personally.
The consumer is responsible only if the product suffered a loss of value because it was not used properly, not the way it would be necessary for establishing its character, feature, or its workability. Titatuta.com can hold back the money payback until we do not get back the product, or if the consumer does not justifies the he/she sent it back: we must take into consideration the earlier date of the two.
The right to withdrawal cannot be practised
- in case of such product, which wasn’t manufactured in advance, which was created for the specific request of the consumer, according to his/her demands, or in case of such product that was designed specifically for the personality of the consumer;
- in case of such closed-packaged product, which cannot be sent back after the delivery and the opening of the package, because of healthcare or hygienic reasons;
- in case of sale of closed packaged tape-recording or video-recording, and computer software, if the consumer opened the product’s package after the delivery;
- in case of digital data provided not on object data carrier, if the enterprise started the fulfilment of a service on the consumer’s specific and previous consent, and at the same time of his/her consent declaration, the consumer also declared the acknowledgement of that he/she loses the right for withdrawal after the web shop began the fulfilment of the order;
- by customers who does not count as consumers, for contracts signed by the aim of economical or professional activity;
- and in other cases defined by regulations or/and law.
The limitation of responsibility
Purchasing on Titatuta.com the customer recognizes and accepts the possibilities and limitations of the internet, with special respect to technical performance of the network and possible errors.
Because of this, Titatuta.com excludes the responsibility for any of the following points, no matter what reason they may happened:
- the alterations, or missing of any data sent or received via the internet;
- any type of error occurring in the internet network;
- in case of software error, or any kinds of technical error, that occurred in hardware or any other device.
Titatuta.com does not take responsibility for any direct or indirect damage that occurred because of a visit to Titatuta.com website.
The customer owes complete and unlimited responsibility for damages originating from the providing and publishing of his/her personal data.

Titatuta.com provides the consumer complaint given in this way with a special identification number, then – because of lack of other legislative regulations – answers it in written form within 30 days. Complaints must include the name and address of the person who complain, the description of the complaint, and other data provided in regulations. Titatuta.com must give reasons for her declining a complaint, and we may raise the customer’s attention to further possibilities for legal remedy.
